Please read these Terms of Use ("Agreement" or "Terms of Use") carefully before using the website and services offered by www.HarshanBhardwaj.com, Mumbai, India.

The Agreement outlines the legally binding terms and conditions for your use of the website at www.HarshanBhardwaj.com (the "Site") and all services provided by Harshan Bhardwaj on the site, venue, or online, in India or abroad.

By using the Site in any manner, including but not limited to visiting or browsing the Site, you ("user" or "you") agree to be bound by this Agreement, including the additional terms, conditions, and policies referred to here and/or available at www.harshanbhardwaj.com/tnc.

This Agreement applies to all users of the Site, including, without limitation, clients, customers, organizers, content contributors, and any parties using the services of Harshan Bhardwaj. Failure to use the Site or Services in accordance with these Terms may subject you to legal action.

​Definitions

Artist: Refers to Harshan Bhardwaj, whether as an individual live performer or as part of a group booked for an event through this website.

Event: The duration during which the Artist performs, either in person or virtually, as specified in the booking.

Client or Organiser: The individual, company, or group that has made the booking for the artist.

Enquiry, Confirmation & Booking

  1. Any verbal discussions or informal communications do not constitute a valid booking.

  2. Bookings without a minimum 50% deposit are considered null and void, treated merely as inquiries, not confirmed engagements.

  3. All booking communications must be conducted in writing, such as via email, formal message, or official correspondence.

  4. A 50% non-refundable deposit, to be paid exclusively via bank or UPI transfer, is required to secure a booking.

  5. Payments via cash, cheque, or on-site/same-day methods are not accepted under any circumstances.

  6. Verbal agreements or provisional holds do not guarantee a booking unless formalized with a 50% deposit.

  7. Amendments or clarifications regarding bookings must also be documented in writing to ensure accuracy and acknowledgment by both parties.​

Travel, Accommodation & Hospitality

  1. Travel expenses are not included in the performance fee and must be discussed and mutually agreed in writing.

  2. If applicable, travel expenses must be paid in advance at the time of booking.

  3. Food, accommodation, and local hospitality are the responsibility of the Client/Organiser/Event Host.

  4. Proper cleanliness, quality, and hygiene standards must be maintained in both food and accommodation arrangements.

  5. Unsafe or unhygienic arrangements can be declined by the Artist without refund obligations.

Payment Terms

  1. For bookings made more than 30 days in advance, 50% deposit is required upfront, and the balance must be paid at least 7 days before the event.

  2. No payment will be accepted on the day of the event or afterward.

  3. Only bank or UPI transfers are valid modes of payment.

​

Cancellations

  1. Advance payments are non-refundable under any circumstances.

  2. If cancellation is made 45 days or more before the event, 75% of the total amount will be due and payable.

  3. If cancellation is made within 30 days of the event, 100% of the performance fee becomes due and payable.

  4. All cancellations must be communicated in writing and acknowledged by the Artist to be valid.

Changes to Booking Details

  1. Any change to event schedule, venue, artist lineup, or performance duration must be mutually agreed upon in writing prior to the event.

  2. Last-minute changes are subject to Artist's availability and discretion.

​

Performance Conditions

The Client must ensure:

  1. A secure and adequate stage area as per Artist's technical requirements.

  2. Timely access to the venue for soundcheck and setup.

  3. Safe and respectful environment for all crew members.

  4. Clean greenroom and access to washrooms.

  5. Covered stage space for outdoor shows (with proper rain contingency).

  6. Artist holds the right to cancel or stop performance due to unsafe, unhygienic, or disrespectful conditions, with no refund applicable to the Client.

Soundcheck and Rehearsals

  1. A dedicated soundcheck time must be arranged in advance.

  2. If rehearsals with other performers (e.g. anchors, dancers) are required, they must be scheduled separately and may incur additional fees.

Promotion and Media Rights

  1. The Artist reserves the right to use photos, videos, & audio from the event for social, professional or promotional purposes.

  2. Any live broadcast, or live-streaming of the performance must be discussed in advance.

  3. Copyright and performance rights licenses (e.g. IPRS, PPL, YouTube/Facebook streaming clearance, etc.) are the responsibility of the Client/organiser.

  4. Exceptionally, upon mutual discussion, such rights can be managed by the Artist / team, which must be paid separately in advance.

Indemnity Clause

  1. Both parties agree to indemnify and hold each other harmless from any claims, liabilities, or damages caused by breach of this agreement or any external unforeseen circumstances during the event.

  2. The Artist is not responsible for:

    • Guest misconduct

    • Venue mismanagement

    • Technical faults from third-party vendors

    • Delays or cancellations due to natural calamities, strikes, accidents, or health emergencies

Force Majeure

  1. Neither party shall be liable for any failure to perform its obligations where such failure is caused by unforeseen events beyond reasonable control including war, strike, natural disaster, pandemic, fire, or government restrictions.

Insurance & Risk

  1. The Client is responsible for ensuring safety protocols, security, venue clearance, and any necessary insurance (including public liability if applicable).

  2. The Artist is not liable for damages to property, equipment, or any accidents caused by third parties or venue lapses.

Performance Agreement Supremacy & Continuity Clause

  1. Each event will be governed by a dedicated Performance Agreement, prepared specifically for that booking.

  2. This detailed agreement will outline all mutually discussed adjustments, terms, and service expectations.

  3. However, these general Terms of Use will always remain in full effect, and any changes agreed for a specific event shall be treated as an addendum to these terms, not a replacement.

  4. Both the Client and the Artist agree to abide by these Terms of Use in conjunction with the individual performance contract.

Additional General Terms & Client Responsibilities

  1. The Client must ensure punctuality in venue access, setup, and payment.

  2. Any intoxicated, unruly, or violent guest behaviour during the event must be controlled by the organiser immediately.

  3. Stage, lighting, and sound quality must meet mutually agreed standards; poor conditions may affect performance quality and cannot be held against the Artist.

  4. The Artist's brand name, photographs, or profile may not be used in marketing or ticketing without written approval.

  5. If the Artist is being presented as a “surprise act” or part of a multi-artist lineup, the event manager must coordinate discreetly and respectfully.

  6. The organiser is responsible for arranging any necessary performance permissions from venues, societies, or public locations.

  7. No client or representative is allowed to approach the artist for additional requests or changes during the performance without coordination with the manager.

Governing Law & Dispute Resolution

  1. This Agreement is governed by the laws of India.

  2. Any disputes arising from these Terms will be subject to the jurisdiction of the courts in Mumbai, Maharashtra.
